Collaborative Arrangements

The Police & Crime Commissioner for Cleveland and/or on behalf of Cleveland Police have entered into the following collaborative agreements since November 2012.

Where appropriate, and for security details, a copy of the contract may not be available however brief details about the benefits of the contract will be provided.

The Parties wish to enter into Collaboration Agreement pursuant to Section 22A (2) (c) of the Police Act 1996 for the provision of a Director of Collaborative Legal Services serving the Evolve Force areas.

Police & Crime Commissioner for Cleveland and the Police & Crime Commissioner for North Yorkshire

May 2016

The Commissioners wish to enter into a Collaboration Agreement pursuant to the duties under Section 22A Police Act 1996 ("the 1996 Act") for the provision of services under Schedule 1 to the Police Reform and Social Responsibility Act 2011 ("the 2011 Act").

This Agreement is made pursuant to

    • the individual obligations of the Commissioners to appoint an individual under paragraph (7)(1) of Schedule 1 to the Police Reform and Social Responsibility Act 2011 ("the 2011 Act")
    •  the recommendation of the North Yorkshire Police & Crime Panel, supporting the candidacy of Mr Simon Dennis ( " Mr Dennis ") for the proposed senior appointment to the Commissioner for North Yorkshire.

This Agreement provides support by a Policing Body for another Policing Body (a Policing Body collaboration provision) pursuant to s22A(2)(c) of the 1996 Act. The Policing Bodies are of the view that this Collaboration Agreement is in the interests of the efficiency or effectiveness of the Policing Bodies and have consulted with their respective Chief Constables.

North East Forces Collaborative Agreement

Ongoing

A number and variety of collaborative arrangements for the delivery of policing services are already in place nationally and across the NPCC NE Region. On behalf of the Region, as part of responsibilities under an agreed lead force model, North Yorkshire Police has undertaken a review of the two services of Chemical, Biological, Radiological and Nuclear (CBRN) and the Disaster Victim Identification (DVI) aspect of the wider Civil Contingencies response. From this review, outline business cases for these service responses have been formally approved by the Region's Chief Constables and Police and Crime Commissioners. A single Section 22A Agreement between all seven forces in the Region is required to form the legal  basis for collaborative working.

This agreement provides a single, overarching legal agreement for the entirety of the NPCC NE Regions seven policing services, and other partners, for collaboration.  Two sub-functional Agreements for CBRN and DVI will follow. As joint working progresses individual sub-functional service agreements may be added to this overarching agreement rather than requiring a new Section 22A Agreement each time.

Specialist Legal Support for Other OPCCs

Cleveland OPCC provides specialist legal services support to other OPCCs upon request and by individual agreement; collaboration agreements are in place for any such arrangements; for the purposes of s23E(1)(b), for reasons of solicitor-client confidentiality, agreements are not routinely published. The Commissioners wish to enter into a Collaboration Agreement pursuant of Section 22A Police Act 1996 for the provision of Chief Finance Officer services. The Agreement is pursuant to:

    • the individual obligations of the Commissioners to appoint a Chief Finance Officer under paragraph 6(1)(b) of Schedule 1 to the Police Reform and Social Responsibility Act 2011; and

    • the recommendation of the north Yorkshire Police & Crime Panel, supporting the candidacy of Mr Michael Porter for the proposed senior appointment in the role of Chief Finance Officer to the Commissioner for North Yorkshire.

This Agreement provides for support by a policing body for another policing body (a policing collaboration provision) pursuant to s22A(2)9c) for the 1996 Act. The Policing Bodies are of the view that this Collaboration Agreement is in the interests of the efficiency or effectiveness of the Policing Bodies and have consulted with their respective Chief Constables.

The Commissioners have agreed to enter into the collaboration in order that the Commissioner for Cleveland will provide support by way of Chief Finance Officer services, to the Commissioner for North Yorkshire

June 2014

Police & Crime Commissioner for Cleveland, Durham Police & Crime Commissioner, Northumbria Police & Crime Commissioner, Chief Constable of Cleveland Police, Chief Constable of Durham Constabulary & Chief Constable of Northumbria Police with the North East Regional Special Operations Unit (NERSOU)

October 2013 (supplemented March 2015)

The objective of the arrangement is to provide additional capacity and capability across the region to tackle serious and organised crime. The agreement was varied in April 2015 to incorporate additional regional functions.

Please note: A copy of this collaboration agreement is not available online on the grounds that publication could reveal - and therefore undermine the effectiveness of- operational tactics.
