Decisions of the PCC - October 2015

On this page, any decisions made by the Police and Crime Commissioner for Cleveland will be published. The table below outlines each decision supported by the Decision Form used by the Commissioner to justify the decision.

Community Remedy – Community Payback (unpaid   work

Community Remedy was introduced in the Anti-Social Behaviour, Crime and Policing Act 2014. It is a tool to give victims a say in the out of court punishment of perpetrators for low level crime and anti-social behaviour. 

Following feedback from a consultation by the Office of the Police and Crime Commissioner in March 2014, a list of options were identified and agreed in order for victims to indicate their preference as to how the perpetrator should be dealt with. One of the options on the list includes reparation.

Reparation allows the victim or Police Officer to seek appropriate community work to repair the harm caused if/when possible. Examples include: fixing a damaged fence or clearing litter from the victim’s garden. If there is no appropriate reparation found then the perpetrator can be referred to an appropriate reparation scheme. For adults this will be facilitated by   ARCC (Community Rehabilitation Company).

When referred to ARCC the perpetrator will be interviewed and assessed to as to their suitability for the type of work to be completed. The victim will be   consulted with in regards to this. The individual will then be allocated a work placement. Information on the perpetrators appointments and   attendance will be shared with the RJ co-ordinator for monitoring and   recording purposes.

Community Payback has wide reaching benefits, it is intended as a punishment and also as a means by which perpetrators can make amends to the individual / community for the harm they have caused. This in turn allows the perpetrator to understand the consequences of their actions and also gives the victim the satisfaction that the perpetrator has been dealt with appropriately and fairly.

Where practicable supervised group sessions will be utilised to achieve value for money, however dependent upon referrals individual placements may need to be commissioned.

Additional Income

There are a number of instances throughout the year where additional work is incurred by the Force, for which income is received. To ensure that this does not have a detrimental impact on the services provided by Cleveland Police to the people of Cleveland the overall budget available to the Chief Constable is increased to reflect this additional work for which the PCC will   receive additional income.

Foreign Nationals

Cleveland Police have a legal duty to provide foreign nationals with a certificate   of confirmation of their registration. This is a national, legal   document relied upon by the certificated person to prove his or her   legitimacy to reside in the UK. The PCC receives income in relation to the work done around Foreign Nationals and therefore the request is for   £1,206 to be provided from this income to pay for these certificates.

Security Managers Course

The course is designed for staff within the business sector to be made aware of the direction of the threat towards their business as well as any steps they can take to reduce this risk and reduce the dependance on the Cleveland Police resources. The additional costs incurred in delivering this course were £1,590.90, with income generated of £3,250. The request is therefore that the funds available to the Chief Constable are increased by £1590.90.


During the year a number of additional secondments have been approved to aid individual development and to support national work. Some of these   secondments require either backfilling or acting up arrangements to be put in place. One such secondment is expected to result in the receipt of £142k of income by the PCC and the Force have requested that these additional funds are made available to them to put in place the required back fill and cover arrangements.

Mutual Aid funding

The force has supported a number of Mutual Aid deployments between April 15 - Sept 15 which were not part of the budget set at the start of the year. In line with national guidelines the provision of Mutual Aid is charged to the Force to whom the Mutual Aid is being provided.

The Force has incurred expenditure, that was not provided for when setting the 2015-16 budget in providing Mutual Aid, of £57,716. The total amount to be reimbursed to Cleveland for providing these services is £79,417, which takes into account the full costs, in line with national charging agreements, of the services provided.

The Force are therefore requesting the release of £57,716, from the income to be recevied by the PCC, to pay for the additional costs that they have incurred in providing this Mutual Aid. This will result in an increase in the budget available to the Chief Constable of £57,716 which will in turn ensure that the provision of Mutual Aid has not reduced the funding available to the Chief Constable for Policing within Cleveland.

The Mutual Aid deployments covered within this Decision are as follows:

  • Operation Magic - Royal        Visit - South Yorkshire Police
  • Sheffield Wednesday v        Leeds - Sporting Event - South   Yorkshire Police
  • Barnsley v Sheffield        United - Sporting Event - South   Yorkshire Police
  • Sunderland v Newcastle -        Sporting Event - Northumbria Police
  • Operation Tiffany -        Sporting Event - Lincolnshire Police
  • Hull City v Manchester        United - Sporting Event - Humberside   Police
  • General Election 2015 -        Met Police
  • Operation Theta - EDL March        - South Yorkshire Police
  • Operation Time - Birtain        First - South Yorkshire Police

The 'over-recovery' of income of £21,701 will increase the underspend currently forecast during 2015/16 and will be made available to support future financial plans.

Agreement for Operational vehicles   and spare parts

For the provision of Operational vehicles and spare part purchases, a   collaborative procurement exercise was conducted through the Crown Commercial Service (CCS) vehicle framework contracts. In order to achieve efficiencies and economies of scale based on the overall operational vehicle volumes required from each force, the collaborative group agreed to use an e-auction exercise through the CCS procurement portal as the most cost effective route to procuring from the framework   contracts.

The PCC for Cleveland approved the contract award on the 20th July 2015, however following this decision a selected provider advised that they could not meet the particular stipulations of the contract. Following legal advice the Category 6 contract was re-procured. A further e-auction was held on 23rd September.

Wide Area Network (WAN) Support and Rationalisation

Following a Service Review of the current supply & support contract it was   identified that there could be savings made and an opportunity to upgrade the WAN circuits.

The current solution is based on point to point, hub and spoke architecture.  The Force needs to migrate this to a hybrid solution by making use of point to point and MPLS Technology.

The main objectives of the tender exercise are to ensure the Force has an effective and efficient Network Infrastructure in-line with the Force ICT Strategy and future needs; to reduce the current annual support costs; carry out a WAN upgrade at the same time which will result in not having to fund a separate WAN Upgrade Project in 2016/17.

The route to market chosen is the recently awarded Crown Commercial Services Network Services Agreement RM1045.

The investigation and evaluation of all procurement routes has been conducted in a fair, comprehensive, thorough and transparent process.

Telephony Refresh

The business case for the refresh of telephony equipment across the Force estate and Office of the Police & Crime Commissioner is attached to this   document. In summary:

  • Cleveland Police currently        have a telephony environment based on old technology PABX Telephone        switches provided and supported by Unify (previously Siemens). The        ongoing support costs of this equipment is significant         i.e. c£211k pa in 2016/17 (this may increase further if additional        equipment falls out of support).
  • These switches are based        on old hardware and software versions which are now out of support        and therefore cannot be upgraded.
  •  This leaves the        Force unable to complete the effective roll out of Agile Working as        restrictions using the current telephone technology would impact on        the ability of people to work seamlessly at any location.
  • The current telephony        environment (internal extensions and control room) in Ladgate Lane has        no resilience for emergency and non- emergency calls. In the event of        failure calls are directed to Durham.
  • Previous innovation        funding has enabled the deployment of Cisco Unified Communication (UC)        solution,  partially delivering Instant Messaging, Presence        Awareness and Voicemail, the proposal within this document seeks to        build on that initial investment

This Business Case clarifies the main drivers for investment now which includes :-

  • Reduction in ongoing        support costs for the Force (due to ceasing of the Unify contract c£211k        pa)
  •  Ageing technology        (some current equipment/software is already out of support and on a        best endeavors fix basis with Unify ) - this could impact on the service        provided to the Public if there was a hardware failure
  • Improved resiliency        required for critical areas e.g. Control Room
  • Complete before the move        into the new Community Safety Hub (CSH) as this is the most cost        effective and efficiency timing for this upgrade to take place.

The Estimated costs are   pre-tender estimates and include the purchase of Hardware/Software/Licenses and resource effort to implement. The   refresh will provide cashable savings of £196k per annum through reduced   support and maintenance costs.

It is expected that the after the initial investment of £700k is made that savings of £1.1m with be made over the folowing 6 years from reduced support and maintenance costs.

MARAC Support 2015/16

The PCC has received £15,000 of additional funding from Middlesbrough Council who in turn received this funding from the Home Office to support MARAC work.

The Force have requested that the funds are made available to support the procedural work of ensuring that all relevant background work is completed in a timely manner to inform the MARAC decision making process. This will enable better management of the current workload of the team and will allow the prioristisation of MARAC actions so as they are completed in the shortest possible time. This will further support and   develop partnership working as this will be done in conjunction with the IDVA provision.

This should then aid the requirement for the MARAC to truly be an instrument that achieves Intervention, Protection and Prevention. 

This funding will assist in the current workload demands in the current financial year, relieving the current pressures faced on the MARAC process.  It is expected that the MARAC process will become more sustainable as a review of the SOP’s (standard operating procedures) will be completed, additional staff will be employed for contact/satisfaction work (funded by PCC) and the structure in Protecting Vulnerable People will alter to be more flexible and responsive.

Additionally the Force have initiated work to improve the MARAC process through review, the setting up of a regional meeting and the creation of a steering group to give the process oversight.

Integrated Dog Support Unit (Cleveland Police, Durham   Constabulary and North Yorkshire Police)

Cleveland Police and Durham Constabulary are already collaborating on dogs section provision.However, under the Evolve Programme, it will build on this further, extending the service to a more cohesive three-way Integrated Dogs Support Unit, which includes the North Yorkshire Police area The key features and benefits of the Integrated Dogs Support Unit are:

  • A single command structure        to provide clarity of leadership, management responsibility and enhanced        operational oversight
  • Standardized training and        tactical approach, to ensure inter-operability across the entire        geography
  • Consolidation of the        existing operational centres at Wynyard and Spennymoor, and additional        centres at York, Harrogate, East Coast, Northallerton/Thirsk, to give        breadth of deployment coverage.  (Operational centres are locations        where dogs can be transferred to police vehicles and kennelled for short        periods, and where handlers can book-in for duty).
  • Access to a larger        combined pool of trained police dogs (double the current capacity),        which will ensure there are more police dogs available for duty at any        one time than previously, increasing resilience and operational reach –        including in previously hard-to-reach rural communities
  • Access to the full range of        specialist police dog skills within a single unit
  • Ability to match        deployment to demand more effectively
  • Potential for greater        proactivity within the service

As with all Evolve Programme projects, a key driver behind the initiative is to reduce operating costs as well as improving service.

It is anticipated that cost savings will be in excess of £600k per annum (£179k for Cleveland, £259k for Durham and £172k for North Yorkshire) – or £3m over the next five years. This reduction would be achieved through realignment of the current resources, and by realizing the savings resulting from the disestablishment of current vacancies, and “natural reductions” such as scheduled retirements. There will be no redundancies as a result of this proposal, and it is not anticipated that extra police dog retirements (beyond those scheduled) will be required.
