Executive Summary
On 3rd July 2026, the Police and Crime Commissioner (PCC), in his capacity as the Pension Supervising Authority (PSA) for Cleveland Police, considered whether to submit an application to the Home Secretary for a Certificate of Forfeiture in respect of a former Cleveland Police officer who has been convicted of serious criminal offences, including sexual offences.
The Police Pension Regulations provide that a police pension may be forfeited, in whole or in part, where a former officer has been convicted of an offence committed in connection with their service as a member of a police force and the offence has been certified by the Secretary of State as being liable to lead to a serious loss of confidence in the public service.
Under Regulation K5 of the Police Pensions Regulations 1987, together with the corresponding provisions of the Police Pension Regulations 2006 and 2015, the PCC has the authority to apply to the Home Secretary for a Certificate of Forfeiture where the relevant statutory criteria are considered to be satisfied.
Having considered the circumstances of the case, including the nature and seriousness of the offences, the connection between the offending and police service, the relevant Home Office Police Pension Forfeiture Guidance, and representations made by the former officer, the PCC determined that an application should be submitted to the Home Secretary for a Certificate of Forfeiture.
