FOI Response
Regarding your request I can now inform you that I have completed my enquiries and that my reply on behalf of the Office of the Police and Crime Commissioner for Cleveland is as follows.
The Office of the Police & Crime Commission for Cleveland does hold information on this subject.
I have attached to this response a list of properties and land. The District references in that document are as follows. H – Hartlepool, M – Middlesbrough, S – Stockton and L – Redcar and Cleveland.
Property List (application, 60kB)
However by virtue of s31(1)(a) of the Act I can neither confirm nor deny if this is an exhaustive list of premises or land held by the Police and Crime Commissioner.
Section 31 is a prejudice based exemption and is subject to the public interest test. This means that not only does the information have to prejudice one of the purposes listed, but, before the information can be withheld, the public interest in preventing that prejudice must outweigh the public interest in disclosure.
A s31 exemption and especially sections 31(1)(a) – (f) provide protection for information which would prejudice general law enforcement activities.
We acknowledge the public interest in openness and transparency, but we consider that there is also a public interest in the Office of the Police & Crime Commissioner for Cleveland protecting law enforcement activities.
